These terms govern access to and use of SchemaHR, provided by Ackberry Technologies. By creating an account or using SchemaHR, you agree to them.
Last updated 1 September 2026
These Terms of Service (“Terms”) are a contract between you and Ackberry Technologies (“we”, “us”, “SchemaHR”), a company based in Nairobi, Kenya. They apply to any organisation that registers a SchemaHR account (a “Client”), to the individual users a Client authorises on its account, and to candidates who apply for a job through SchemaHR.
By registering a company, creating a user account, or submitting a job application through SchemaHR, you agree to be bound by these Terms and by our Privacy Policy. If you are agreeing on behalf of an organisation, you confirm you have authority to bind that organisation.
SchemaHR is a hosted applicant tracking system that lets a Client post jobs, receive and screen applications, run AI-assisted candidate scoring, administer assessments, schedule interviews, collect compliance documents, and manage offers, through a single hiring pipeline. Available features depend on the Client’s plan (Pack, Starter, Growth or Enterprise) and any feature flags enabled on the account.
A Client must provide accurate registration information and keep it up to date. New company registrations are reviewed before an account becomes active. A Client is responsible for all activity under its account, for the conduct of the users it invites, and for keeping login credentials secure. Notify us promptly at the contact in Section 16 if you suspect unauthorised use of an account.
Candidates do not need to actively manage an account to apply for a job; an application creates a record used to run the hiring process described in our Privacy Policy.
SchemaHR is offered as a one-time application Pack (fixed volume, valid 12 months from purchase) or as a recurring Subscription (Starter, Growth or Enterprise, with a monthly application quota that resets each billing cycle). New accounts may start on a time- or volume-boxed trial before any payment is required.
Paid access is activated only once an invoice we issue has been paid, whether by mobile money (M-Pesa), card or PayPal, bank transfer, or another method we support. Prices are shown in Kenyan Shillings or US Dollars depending on the currency you choose at checkout; the amount you are charged is the amount shown at checkout.
If a Subscription’s monthly quota is used up before the cycle resets, new applications are paused, not rejected, until the quota resets, additional Pack credits are applied, or the plan is upgraded. We do not silently drop applications for reaching a limit.
Subscriptions renew for successive periods unless cancelled before the renewal date. If a renewal invoice is not paid, the account enters a grace period and then loses access if payment is not received; Pack credits already purchased are unaffected by a lapsed Subscription. Fees already paid are non-refundable except where required by law or where we agree otherwise in writing.
You agree not to use SchemaHR to:
We may suspend or terminate access for a breach of this section, consistent with Section 11.
A Client retains ownership of the job listings, screening questions, and other content it creates in SchemaHR, and grants us a licence to host, process, and display that content as needed to provide the service.
As between a Client and SchemaHR, the Client is responsible for having a lawful basis to collect and process the personal data of its candidates, and for the accuracy of the job and screening content it publishes. SchemaHR processes candidate data as described in our Privacy Policy, acting on the Client’s instructions.
SchemaHR’s AI-assisted scoring, extraction, and summarisation features are provided as decision support for a Client’s recruiters. They are not guaranteed to be complete, accurate, or free of error, and are not a substitute for human judgement in a hiring decision. A Client remains responsible for its own hiring decisions.
Where SchemaHR’s compliance workflow reviews a candidate’s uploaded documents, that review checks completeness and consistency only (format, name matching, expiry dates) and does not constitute government-authenticated verification. A Client that requires certified document authentication should engage an accredited background verification provider.
SchemaHR, its underlying software, design, and branding are the property of Ackberry Technologies and are protected by intellectual property law. These Terms grant a Client a limited, non-exclusive, non-transferable right to use SchemaHR for its own hiring activities. Nothing in these Terms transfers ownership of our platform or IP to a Client or any user.
Each party will protect the other’s confidential information with reasonable care and use it only to perform under these Terms, except where disclosure is required by law or with the disclosing party’s consent. This obligation survives termination of these Terms.
We aim to keep SchemaHR available and reliable, and perform maintenance and updates from time to time. Except where a written Enterprise agreement states a specific service level, SchemaHR is provided without an uptime guarantee, and we are not liable for downtime caused by factors outside our reasonable control, including third-party infrastructure or payment-provider outages.
These Terms apply for as long as a Client maintains an account. We may suspend or terminate an account for non-payment, breach of Section 5, suspected fraud, or a legal requirement to do so, and will where reasonably possible give notice first. A Client may stop using SchemaHR, or cancel a Subscription, at any time; access continues through the period already paid for.
On termination, a Client may request an export of its active data within a reasonable window before it is deleted in line with our data retention practices, described in our Privacy Policy.
SchemaHR is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Ackberry Technologies’s total liability arising out of or relating to these Terms or the service is limited to the fees paid by the Client in the 12 months preceding the claim, and we are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits or data, even if advised of the possibility. Nothing in these Terms limits liability that cannot lawfully be limited, such as liability for fraud or wilful misconduct.
A Client agrees to indemnify and hold Ackberry Technologies harmless from third-party claims arising from the Client’s job content, its unlawful processing of candidate data, or its breach of these Terms, to the extent caused by the Client.
These Terms are governed by the laws of Kenya. As SchemaHR expands to serve organisations in other African markets, we will apply these Terms as a baseline everywhere we operate, and will provide jurisdiction-specific additions where a country’s law requires terms beyond what is set out here. Disputes will first be addressed through good-faith negotiation between the parties before either party pursues formal proceedings in the courts of Kenya, unless a separate written agreement between the parties says otherwise.
We may update these Terms from time to time. We will post the updated version here with a new “last updated” date, and, for material changes, take reasonable steps to notify Client administrators. Continued use of SchemaHR after a change takes effect constitutes acceptance of the updated Terms.
Questions about these Terms can be sent to support@schemahr.com.
